1. Acceptance of Terms

By accessing and using useEducator's school management system ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this Service.

2. Use License

Permission is granted to temporarily access and use the Service for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to reverse engineer any software contained in the Service
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms. You are responsible for:

• Maintaining the confidentiality of your account and password
• Restricting access to your computer and account
• All activities that occur under your account or password

4. Data Protection and Privacy

We take data protection seriously. Your use of the Service is also governed by our Privacy Policy. We implement appropriate technical and organizational measures to protect student and institutional data. Educational institutions maintain ownership of their data and can export or delete it at any time.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of useEducator and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without prior written consent.

6. Acceptable Use Policy

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation
• To transmit or procure the sending of any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate the Company, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service

7. Subscription and Payment Terms

Certain aspects of the Service are provided on a subscription basis. You will be billed in advance on a recurring and periodic basis. Billing cycles are set on a monthly or annual basis, depending on your selected subscription plan.

Subscription fees are non-refundable except as required by law or as explicitly stated in your subscription agreement. Price changes will be communicated with at least 30 days' notice.

8. Service Availability and Support

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. Scheduled maintenance will be announced in advance when possible. Technical support is available during business hours for all active subscribers.

9. Limitation of Liability

In no event shall useEducator, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may cancel your subscription at any time through your account settings or by contacting support.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. Material changes will be notified at least 30 days before the effective date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Nigeria.
